If you or someone you know is charged with a crime you are entitled to the following constitutional rights:
- Right to a trial.
- Right to remain silent and your silence cannot be used against you at trial.
- Right to testify and present evidence at trial.
- Right to use subpoenas to require witnesses to come to court and testify for you.
- Right to a jury trial, where all twelve jurors would have to agree that you are either guilty or not guilty.
- Right to confront in court the people who testify against you and cross examine them.
- Right to make the State prove you guilty beyond a reasonable doubt.
- Right to be represented by competent defense counsel.
If you are charged with a crime, there may be a variety of pretrial motions that can be brought on your behalf to exclude evidence or have certain charges dismissed prior to trial.
If you are arrested or charged with a crime it is in your best interest to not give any statements to law enforcement or investigators until you have had an opportunity to meet with an attorney and discuss your situation.
With the help of competent legal counsel the charges against you may be resolved by a plea agreement.
If you cannot afford your own attorney, you may apply for representation through the Wisconsin Public Defender’s Office.
